By accessing this website or engaging our services, you agree to comply with these Terms.

2. Services Provided

We provide:

• Wildlife and nature photography
• Landscape and environmental imagery
• Commercial and editorial photography
• Drone (UAV) photography and videography
• Mining, industrial, and remote-site photography

All services are subject to availability, site access permissions, and safety requirements.

3. Compliance with Australian Laws

All work is conducted in accordance with:

• Civil Aviation Safety Authority (CASA) regulations
• Western Australian environmental and land access laws
• Mining site-specific safety and operational requirements

Drone operations are conducted by a licensed and/or registered operator where required.

4. Drone Operations

By engaging our drone services, you acknowledge:

• Flights are subject to:
  
  • Weather conditions
  • Airspace restrictions
  • Safety risks
• We reserve the right to cancel or reschedule flights at our discretion
• No flights will occur:
  
  • Over people without approval
  • In restricted or prohibited airspace without permits
• Client must disclose:
  
  • Site hazards
  • Operational constraints
  • Required approvals

Additional permits, escorts, or inductions may incur extra costs.

5. Mining & Industrial Site Work

For mining and industrial photography:

• Client must provide:
  
  • Site access approval
  • Safety inductions
  • PPE requirements
• We reserve the right to refuse work if:
  
  • Conditions are unsafe
  • Compliance requirements are not met

Client is responsible for:

• Site-specific safety compliance
• Escort requirements
• Permits and internal approvals

6. Bookings & Payments

• Quotes are valid for 14 days unless stated otherwise
• A deposit may be required to secure bookings
• Full payment terms will be outlined in your quote or invoice
• Late payments may incur fees

We reserve the right to withhold delivery of images until payment is received in full.

7. Cancellations & Rescheduling

• Cancellation within 72 hours may incur a fee
• Weather-related rescheduling is allowed at no cost (where applicable)
• Travel and accommodation costs may be non-refundable

8. Intellectual Property & Licensing

All images and media remain the copyright of B.johnson images unless otherwise agreed in writing.

Clients are granted a non-exclusive, non-transferable license to use delivered content for agreed purposes.

Clients must not:

• Resell or redistribute images
• Alter images without permission
• Use images beyond agreed scope
• Re-label media or images 

Commercial usage beyond agreement requires additional licensing.

9. Portfolio & Marketing Use

We reserve the right to:

• Use images for portfolio, website, and promotional purposes
• Share work on social media

If confidentiality is required (e.g., mining projects), this must be agreed in writing prior to the shoot.

10. Environmental Responsibility

As a wildlife and nature photographer:

• We adhere to ethical wildlife practices
• No disturbance or harm to animals or habitats will occur
• Work may be cancelled if environmental impact is deemed unacceptable

11. Client Responsibilities

Clients agree to:

• Provide accurate project details
• Obtain necessary permissions
• Ensure safe working conditions
• Comply with all relevant laws and site rules

12. Liability & Indemnity

To the fullest extent permitted by law:

• We are not liable for:
  
  • Delays due to weather or access restrictions
  • Third-party interference
  • Uncontrollable environmental conditions

Client indemnifies B.Johnson images against:

• Claims arising from site conditions
• Breach of safety or legal obligations

13. Insurance

We maintain:

• Public Liability Insurance
• Equipment Insurance
• Drone operator coverage (where applicable)

Proof of insurance can be provided upon request.

14. Delivery of Work

• Delivery timelines will be outlined in your quote
• Files are delivered digitally unless otherwise agreed
• We are not responsible for file loss after 30 days from delivery

15. Force Majeure

We are not liable for failure to perform due to:

• Weather events
• Natural disasters
• Government restrictions
• Site shutdowns

16. Privacy

We respect your privacy and handle personal information in accordance with Australian Privacy Laws.

17. Website Use

Users of this website agree not to:

• Copy or reproduce content without permission
• Use images unlawfully
• Interfere with website functionality
